3.1 Acceptance

By accessing or using Factiator (factiator.com), you agree to these Terms of Service. If you do not agree, do not use the service. These terms constitute a binding agreement between you and VALINORSK LLC.

3.2 Description of Service

Factiator is an AI-powered epistemic analysis tool — a Claim Intelligence Engine — that evaluates the epistemic quality of claims and fact-check articles. It applies a structured analytical framework to surface confidence scores, source classifications, funding transparency indicators, bias patterns, and counterpositions.

Factiator is a research and reference tool. It is not a replacement for professional journalism, legal advice, medical advice, financial advice, or any other regulated professional service.

3.3 Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction) to use Factiator. By using the service, you represent that you meet this requirement.

3.4 Account Registration

Certain features require account registration. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account.

3.5 Acceptable Use

You may use Factiator for lawful purposes only. You agree not to:

• Submit content that is illegal, harmful, defamatory, or infringes third-party rights
• Attempt to reverse-engineer, scrape, or extract the AI model, prompts, or scoring algorithms
• Use the service to generate disinformation, manipulate public opinion, or create misleading content
• Circumvent usage limits, rate limits, or access controls
• Use automated means to access the service beyond the permitted API
• Resell or sublicence access to the service without written authorisation

3.6 AI-Generated Content — Critical Notice

FACTIATOR ANALYSES ARE GENERATED BY ARTIFICIAL INTELLIGENCE. AI SYSTEMS CAN AND DO MAKE ERRORS. OUTPUTS MAY BE INCOMPLETE, INACCURATE, OUTDATED, OR MISLEADING.

Every analysis output should be treated as a starting point for your own research, not as a definitive verdict. You are solely responsible for:

• Verifying any factual claims before acting on them
• Applying your own judgement to the analysis results
• Any decisions you make based on Factiator outputs

Epistemic scores and verdicts represent the engine's assessment based on available information at the time of analysis. They do not constitute the views of VALINORSK LLC and are not legal, journalistic, or professional opinions.

3.7 Intellectual Property

Factiator, the Claim Intelligence Engine, and all associated software and systems are the intellectual property of VALINORSK LLC.

The Claim Intelligence Engine incorporates a proprietary epistemic framework developed by VALINORSK LLC. The analytical methodology — including the dimensions evaluated, the scoring components, and the epistemological principles applied — is documented publicly on this website for transparency and scientific accountability. The specific implementation, prompt architecture, and technical configuration of the AI engine remain confidential and are not published. This distinction reflects our commitment to transparency about what is evaluated and how evidence is weighted, while protecting the technical implementation as proprietary work product.

Content you submit for analysis may include third-party material — such as articles, claims, or publications authored by journalists, researchers, or other rights holders. VALINORSK LLC does not claim ownership of such third-party content. You are responsible for ensuring that your submission complies with applicable copyright law and the terms of use of the original source.

Where you submit original content of your own creation, that content remains your property. In all cases, by submitting content you grant VALINORSK LLC a limited, non-exclusive licence to process and analyse it solely for the purpose of providing the requested analysis.

Analysis reports generated by Factiator are published under a permanent public URL. Sharing and citing these reports is permitted provided attribution to Factiator (factiator.com) is included and the AI-generated nature of the analysis is disclosed.

3.8 Subscription and Billing

Paid tiers are billed monthly or annually via Stripe. All fees are stated in USD. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are provided at our discretion for unused periods. VALINORSK LLC reserves the right to modify pricing with 30 days notice.

3.9 Termination

VALINORSK LLC may suspend or terminate accounts that violate these Terms. You may cancel your account at any time. On termination, your access ceases and data is deleted per the Privacy Policy.

3.10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VALINORSK LLC AND ITS MEMBERS, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF FACTIATOR.

VALINORSK LLC's total liability for any claim arising from use of the service shall not exceed the amount you paid to VALINORSK LLC in the 12 months preceding the claim.

3.11 Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, USA. For EU users, mandatory consumer protection rights under local law remain unaffected. Disputes shall first be attempted to be resolved through good-faith negotiation. Unresolved disputes shall be subject to binding arbitration in Sheridan County, Wyoming, USA, or — for EU consumers — before the competent court of your domicile.

3.12 Changes to Terms

VALINORSK LLC reserves the right to modify these Terms. Material changes will be notified by email or prominent notice on the website. Continued use after changes constitutes acceptance.
